In short: OC Window Installation is a free referral service. We collect your project details and connect you with an independent, licensed professional who can do the work. We do not perform the work, we do not employ or supervise the professionals, and we are not responsible for their work, conduct, or agreements with you. Any contract for services is between you and that professional.
These Terms of Service ("Terms") are a binding agreement between you and OC Window Installation ("OC Window Installation," "we," "us," or "our"), the operator of ocwindowinstallation.com (the "Site"). They govern your use of the Site and of our quote request, matching, and referral services (together, the "Services").
By using the Site, submitting a quote request or contact form, or calling a phone number listed on the Site, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site or submit a request.
You must be at least 18 years old and legally able to enter into contracts to use the Services.
We are a lead referral and matching service. We are not a contractor and we do not perform the work.
The only thing we do is collect the information you choose to give us — your name, phone number, email address, city, and a description of your project — and pass it to one or more independent, third-party service professionals who may be able to perform window installation and replacement in Orange County, Riverside County, and Los Angeles County, California. Those professionals ("Service Professionals") are separate businesses. They are not our employees, agents, partners, joint venturers, or franchisees, and we do not control them.
Specifically, we do not:
Any agreement for work is made solely and directly between you and the Service Professional. We are not a party to it, we have no rights or obligations under it, and we are not responsible for its performance by either side.
A referral is not a recommendation, endorsement, certification, or guarantee of any Service Professional or of the quality, safety, legality, timeliness, or price of their work. We do not independently verify, and make no representation about, any Service Professional's licensing, bonding, insurance, workers' compensation coverage, permits, background checks, workmanship, warranties, financial condition, reviews, or business practices.
You are responsible for deciding who to hire. Before you allow anyone to begin work, we strongly recommend that you:
If something goes wrong with your project — defective, incomplete, delayed, or unsafe work; property damage; injury; theft or loss; a cost overrun; a missed appointment; a broken warranty; a billing or refund dispute; or unlawful, abusive, or unprofessional conduct — that dispute is between you and the Service Professional.
You agree that OC Window Installation is not responsible or liable for the acts, omissions, work product, conduct, statements, or agreements of any Service Professional, and that we have no obligation to become involved in, mediate, arbitrate, investigate, or resolve any such dispute. We may, at our sole discretion and with no duty to do so, pass along a complaint or stop referring customers to a particular Service Professional.
When you submit a form on the Site or call a number listed on the Site, you are asking to be contacted. You expressly consent to receive calls, text messages, and emails about your request from OC Window Installation and from the Service Professional(s) we match you with, at the phone number and email address you provide, including calls and texts made using an automatic telephone dialing system, artificial or prerecorded voice, or SMS/MMS.
This consent applies even if the number you provide is on a state or federal Do Not Call list, and it applies to the number you give us whether it is a landline, mobile, or VoIP number. You confirm that you are the subscriber or customary user of that number and are authorized to give this consent.
Consent is not a condition of purchasing any goods or services. Message and data rates may apply, and message frequency varies. To stop text messages, reply STOP to any message. To stop calls or to have your information removed, call us at (714) 400-7795. Calls to or from us or a Service Professional may be recorded or monitored for quality and training purposes where permitted by law.
Our Services are provided to you free of charge. Any price range, cost estimate, timeline, product description, or savings figure on the Site is general informational content for a typical project — it is not an offer, a bid, or a quote, and it is not binding on us or on any Service Professional. Only a written estimate or contract from a Service Professional, based on your actual property and scope of work, is a real quote.
We do not guarantee that any Service Professional will contact you, will be available in your area, will be willing to take your project, or will offer any particular price, financing, promotion, or timeline.
Site content is provided for general informational and marketing purposes. Photographs, project galleries, and illustrations may be representative or stock images and may not depict work performed for you or by the Service Professional you are matched with. Testimonials and reviews reflect the experience of specific individuals and are not a guarantee that you will have the same experience. Certifications, awards, brand names, and manufacturer marks referenced on the Site belong to their respective owners.
We try to keep the Site accurate and current, but we do not warrant that it is complete, accurate, or up to date, and we may change or remove content at any time without notice.
You agree to provide true, accurate, and complete information, to submit requests only for projects you actually intend to have performed, and to submit only your own contact information or information you are authorized to provide.
You agree not to: use the Site or Services for any unlawful purpose; submit false, fraudulent, duplicate, or automated requests; harvest, scrape, or resell Site content, contact information, or leads; interfere with or attempt to gain unauthorized access to the Site, its servers, or its forms; transmit malware or attempt to disrupt the Services; impersonate any person or business; or use the Services to send unsolicited commercial messages.
We may refuse, suspend, or terminate your access to the Services at any time, with or without notice, for any reason.
The Site and its content — text, layout, graphics, logos, images, and code — are owned by OC Window Installation or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, modification, republication, framing, or commercial use without our prior written permission is prohibited.
The Site may link to or embed third-party websites, tools, maps, or content, including sites operated by Service Professionals, manufacturers, or review platforms. We do not control and are not responsible for third-party sites, their content, their products, or their privacy practices. Links are provided for convenience only and do not imply endorsement.
The site and the services are provided "as is" and "as available," with all faults and without warranty of any kind. To the fullest extent permitted by law, OC Window Installation disclaims all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, workmanlike effort, title, accuracy, and non-infringement.
OC Window Installation makes no warranty that the site will be uninterrupted, secure, or error-free, that information on the site is accurate or complete, that you will be matched with a service professional, or that any service professional is licensed, insured, qualified, available, honest, or suitable for your project. OC Window Installation does not warrant, and is not responsible for, any work, materials, products, estimates, or services provided by any service professional.
To the fullest extent permitted by law, OC Window Installation, its owners, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, goodwill, or business opportunity, arising out of or relating to the site, the services, any referral, or any work performed or not performed by a service professional, whether based in contract, tort (including negligence), strict liability, warranty, statute, or otherwise, even if we have been advised of the possibility of such damages.
Without limiting the foregoing, OC Window Installation is not liable for property damage, personal injury, death, defective or incomplete workmanship, code or permit violations, delays, cost overruns, theft, loss, non-performance, misconduct, or any other act or omission of any service professional or of any person you allow onto your property.
In no event will the total aggregate liability of OC Window Installation to you for all claims arising out of or relating to the site or the services exceed the greater of (a) the total amount you paid to OC Window Installation in the twelve months before the event giving rise to the claim, or (b) one hundred u.s. dollars ($100). Because the services are free to consumers, this amount will typically be $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the two sections above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, gross negligence, or willful misconduct.
Because we are only a referral service, you release OC Window Installation and its owners, officers, employees, contractors, and affiliates from any and all claims, demands, damages, losses, costs, and expenses of every kind, known or unknown, arising out of or in any way connected with (a) any dispute between you and a Service Professional, and (b) any work, quote, contract, communication, or conduct of a Service Professional.
If you are a California resident, you waive California Civil Code Section 1542, which reads: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
You agree to defend, indemnify, and hold harmless OC Window Installation and its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site or Services, your submission of any information, your violation of these Terms or of any law, or any dispute between you and a Service Professional.

Informal resolution first. If you have a dispute with us, contact us at (714) 400-7795 and give us 30 days to try to resolve it informally before starting a formal proceeding.
Binding arbitration. Except as stated below, any dispute, claim, or controversy between you and OC Window Installation arising out of or relating to the Site, the Services, a referral, or these Terms will be resolved by final and binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, before a single arbitrator, in Orange County, California, or by telephone, video, or document submission at your election where the rules permit. The arbitrator has exclusive authority to resolve disputes about the interpretation, applicability, or enforceability of this agreement to arbitrate. Judgment on the award may be entered in any court with jurisdiction.
Class action waiver. You and OC Window Installation agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights or to stop unauthorized access to the Site. Nothing here prevents you from filing a complaint with a government agency, including the California Contractors State License Board.
30-day opt out. You may opt out of this arbitration and class action waiver section by calling (714) 400-7795 or writing to us within 30 days of your first use of the Services and stating that you opt out. Opting out will not affect any other part of these Terms.
Disputes with a Service Professional are not covered by this section — they are governed by whatever agreement you have with that Service Professional.
These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration section above, you and OC Window Installation consent to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California.
We may update these Terms at any time. The "Effective date" at the top of this page shows when they were last revised, and the updated version applies to your use of the Site from the date it is posted. Your continued use of the Site or Services after a change means you accept the revised Terms.
If any provision of these Terms is held unenforceable, that provision will be limited or severed and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site and Services and supersede any prior understandings.
